James Bain, a 54 year old man living in Florida was convicted on charges of kidnapping, burglary and rape of a 9-year-old boy in 1974. The 9-year-old boy had told police that his attacker had bushy sideburns and a mustache. He was shown 5 photographs of potential suspects, and picked Bain as his attacker.
Thursday, DNA tests showed Bain did not kidnap and rape the 9-year-old boy. During the investigation Bain's twin sister, Jannie Jones, told police that James was watching TV with her, at the time the alleged attack occured. Bain, who was only 19 years old when convicted, was exonerated earlier this week after spending the last 35 years of his life in prison.
The victim is now 44, and still lives in Florida. He has been made aware of the situation.
Bain's family has stood by him all of these years and will continue to do so. His mother has said she will be taking steps to ensure her son is taken care of in a world that has changed so much since he entered prison. She's putting her house and her car in his name. "I want him to have something by himself. He's suffered enough. He will never worry about where to stay. No more suffering. He'll be taken care of, if anything happened to me," She said.
